1. Scope

This Privacy Policy explains how Creative Fountain Ltd collects, uses, stores, shares and protects personal information when you visit creativefountain.co, buy or use any current or future edition of Fashion Sales Sprint, contact support, request a refund, join a mailing list or otherwise interact with us.

It applies to editions for Nigeria, the United Kingdom, the United States, Uganda, Canada, Australia, Ghana, Kenya, South Africa and any other market. A product-specific notice may supplement this policy. If a local law gives you additional rights, we will honour those rights where the law applies.

2. Our role

Creative Fountain Ltd is normally the controller or responsible party for personal information collected through creativefountain.co and the Fashion Sales Sprint customer relationship. Payment processors, hosting providers, ecommerce platforms and other suppliers may separately control information they collect under their own privacy notices.

3. Information we collect

Depending on how you interact with us, we may collect:

  • identity and contact information, such as your name, email address, telephone number, billing address, country and business name;
  • order and transaction information, such as the product, market edition, amount, currency, payment status, transaction reference, invoice and refund history;
  • product-delivery and usage information, such as access dates, download or delivery records, account activity and the edition or resources supplied;
  • communications, including support messages, refund requests, survey responses, complaints and other correspondence;
  • marketing information, including subscriptions, consent records, preferences and campaign engagement;
  • technical and usage information, including IP address, device and browser information, approximate location, referring pages, pages viewed, timestamps, cookies and similar identifiers;
  • fraud, security and compliance information, including chargeback records, suspicious activity indicators and identity-verification information where reasonably necessary; and

4. How we collect information

We collect information directly from you when you place an order, complete a form, create an account, subscribe, contact us or request a refund. We may collect information automatically through the website and ecommerce systems. We may also receive information from payment processors, banks, delivery platforms, marketing providers, fraud-prevention services and other parties involved in your transaction or request.

5. Why we use information

We may use personal information to:

  • process orders, confirm payments and deliver the correct Fashion Sales Sprint edition;

7. Payments

Payments may be processed by Flutterwave or another payment provider identified at checkout. We normally receive transaction details such as your name, contact details, amount, currency, payment status and reference. We do not normally receive or store your complete card number, security code or online-banking credentials. The payment provider processes payment data under its own privacy notice and security requirements.

8. Cookies and similar technologies

creativefountain.co may use essential cookies for security, checkout, account sessions, shopping-cart functions and product delivery. Where enabled, it may also use analytics, preference or advertising technologies.

Where the law requires consent for non-essential cookies, we will request it through an appropriate consent mechanism. You can also manage cookies through your browser. Blocking essential cookies may prevent checkout, login or download functions from working correctly.

A separate Cookie Policy or consent panel may provide more detail about the specific technologies currently active on the website.

9. Marketing communications

We may send product news, educational content or offers where you have consented or applicable law otherwise permits. You can unsubscribe through the link in a marketing email or by contacting us. Service messages about an order, access, security, refund or policy are not marketing and may still be sent when necessary.

We do not sell or rent mailing lists. If a privacy law treats certain advertising disclosures as a “sale” or “sharing,” we will provide any legally required notice and opt-out mechanism.

10. When we share information

We may disclose relevant personal information to:

  • payment processors, banks, card networks and fraud-prevention providers;

Creative Fountain Ltd is based in Nigeria, and our suppliers may process information in Nigeria, the United Kingdom, the United States or other countries where they operate. This means your information may be transferred outside your country.

Where applicable law restricts cross-border transfers, we will use a recognised legal mechanism or other appropriate safeguard, such as adequacy rules, approved contractual clauses, consent where valid, or a transfer necessary to perform the contract.

12. Retention

We keep personal information only for as long as reasonably necessary for the purposes described in this policy, including to provide access, meet tax and accounting duties, resolve disputes, prevent fraud and enforce agreements.

Transaction and accounting records are normally retained for the period required by applicable law, commonly at least six years. Support and refund records may be kept for a reasonable period after resolution. Marketing records are kept until you unsubscribe or the purpose ends, after which limited suppression information may be retained to respect your choice. Security, delivery and access records are kept only as long as reasonably necessary for fraud prevention, support and legal claims.

Actual periods may be longer where a dispute, chargeback, investigation, legal hold or statutory duty requires it, or shorter where the information is no longer needed.

13. Security

We use reasonable administrative, technical and organisational safeguards appropriate to the nature of the information and the risks involved. These may include access controls, trusted service providers, secure connections, backups, monitoring and staff or contractor confidentiality obligations.

No internet transmission or storage system is completely secure. You are responsible for protecting your account credentials, devices and download links and for notifying us promptly of suspected unauthorised access.

Depending on the law that applies, you may have the right to:

These rights are not absolute. We may retain or continue to process information where the law permits or requires, including for contracts, tax records, fraud prevention and legal claims.

15. How to exercise your rights

Email support@creativefountain.co with the subject “Privacy Request” and describe the right you wish to exercise. We may need to verify your identity and authority before acting. We will respond within the time required by applicable law and will explain any lawful refusal or limitation.

You may use an authorised agent where local law allows. We will not unlawfully discriminate against you for exercising a privacy right.

16. Additional regional rights

The Nigeria Data Protection Act may provide rights and remedies to individuals whose data falls within its scope. UK customers may have rights under the UK GDPR and Data Protection Act. Canadian customers may have rights under PIPEDA or applicable provincial law. Australian customers may have rights under the Privacy Act and Australian Privacy Principles where those laws apply. Customers in Ghana, Kenya, South Africa and Uganda may have rights under their respective data-protection laws. United States residents may have rights under applicable state law, including qualifying rights to know, correct, delete or opt out.

If you believe we have not resolved a privacy concern, you may complain to the regulator or authority available in your country. We encourage you to contact us first so we can investigate.

17. Automated processing

We do not currently make decisions about customers solely through automated processing that produce legal or similarly significant effects. Payment processors and security providers may use automated fraud screening under their own policies. If our practices change, we will provide any notice or choice required by law.

18. Children

Fashion Sales Sprint and creativefountain.co are intended for adults and business users. We do not knowingly collect personal information from children for product purchases. If you believe a child has provided personal information without appropriate authorisation, contact us so we can investigate and take appropriate action.

19. Third-party sites and services

The website or product may link to social networks, payment providers, ecommerce tools, messaging services, artificial-intelligence tools or other third parties. Their privacy practices are governed by their own notices. We are not responsible for a third party’s independent handling of information.

20. Data incidents

If a personal-data incident occurs, we will investigate, take reasonable containment and remediation steps and notify affected individuals or regulators when applicable law requires it.

We may update this policy when our practices, suppliers, products or legal obligations change. We will post the revised version on creativefountain.co and change the effective date. Where a change materially affects your rights, we will provide any additional notice required by law.
